'True Story' Movie -- New Regency To Finance Film About Disgraced ...

EXCLUSIVE: New Regency has made a deal to fully finance True Story. That is the Rupert Goold-directed adaptation of a memoir by Michael Finkel, a disgraced New York Times journalist who discovered that an accused murderer had stolen his identity. Once caught, the fugitive would only talk to the journalist. Jonah Hill is playing Finkel and James Franco is set to play Christian Longo, who was captured in Mexico after rising near the top of the FBI Ten Most Wanted List for allegedly killing his family. Production will begin in July and Fox will distribute.

True Story Movie Plan B?s Dede Gardner, Jeremy Kleiner and Brad Pitt will produce with New Regency. It?s a fascinating and bizarre true story. Finkel was a writer at The New York Times Magazine in 2002 when he learned of Longo?s capture and that the accused killer had taken the journo?s name. The very next day, the real Finkel was fired by Times editors, right after they ran an editor?s note declaring that he had falsified parts of an investigative article. His career seemingly over, Finkel was given a shot at some redemption when Longo declared that Finkel was the only journalist he would talk to. That led to a surreal relationship with the accused murderer, who was trying to declare his innocence. Unraveling the mystery was a chance for Finkel to salvage something of his career.

The deal gives the reconstituted New Regency another star-driven project. Among other projects, the producer-financier teamed with Paramount has closed its deal with Russell Crowe to star in Darren Aronofsky?s Noah for a July 23 start and Regency also has Pitt committed to star in The Gray Man, the James Gray-directed adaptation of the Mark Greaney thriller novel that is expected to start production later this year or early next.

"Titanic" director makes first solo dive to Earth's deepest point

(Reuters) - "Titanic" film director James Cameron has completed the world's first solo dive to the deepest-known point on Earth, reaching the bottom of the Pacific Ocean's Mariana Trench southwest of Guam in a specially designed submarine.

The filmmaker arrived at the site known as "Challenger Deep" shortly before 8 a.m. local time on Monday, reaching a depth of 35,756 feet, or roughly 7 miles beneath the ocean's surface, said the National Geographic Society, which is overseeing the expedition.

Cameron's first words to the surface on reaching the bottom following a descent that took two hours and 36 minutes were "All systems OK," National Geographic said on its website.

"Hitting bottom never felt so good. Can't wait to share what I'm seeing w/ you," the 57-year-old filmmaker said in a separate Twitter message posted just after he touched down.

The low point of the Mariana Trench, a great canyon below the Pacific, has been reached by humans just once before, in 1960 when U.S. Navy Lieutenant Don Walsh and the late Swiss oceanographer Jacques Piccard spent 20 minutes there in the submersible craft Trieste.

Cameron, the first person to make a solo dive to the spot, spent about three hours on the bottom collecting research samples for marine biology, geology and geophysics and taking still photographs and video footage of the trench.

After a faster-than-expected 70-minute return ascent, he safely reached the surface at noon local time Monday (0200 GMT) about 300 miles southwest of the U.S. territory of Guam in the western Pacific, National Geographic said in a press statement.

The expedition was a joint project by Cameron, National Geographic and watchmaker Rolex that has been dubbed "Deepsea Challenge" and was designed to expand understanding of a little-known corner of the Earth.

The Scripps Institution of Oceanography at the University of California, San Diego, is the project's principal science collaborator.

The single-man vehicle piloted by Cameron, the Deepsea Challenger, stands 24 feet tall and was designed to descend upright and rotating at a speed of about 500 feet per minute.

The submersible represents breakthroughs in materials science, structural engineering and imaging through an ultra-small, full-ocean depth-rated stereoscopic camera.

While he is perhaps better known as director of such films as "Titanic," "Avatar" and "Aliens," Cameron is no stranger to underwater exploration. For "Titanic," he took 12 dives to the famed shipwreck in the North Atlantic, leading him to develop deep-sea film and exploration technology.

He has since led six expeditions, authored a forensic study of the German battleship Bismarck wreck site and conducted extensive 3-D imaging of deep hydrothermal vents along the Mid-Atlantic Ridge, the East Pacific Rise and the Sea of Cortez.

The Deepsea Challenge expedition was chronicled for a 3-D feature film set for theatrical release and for subsequent broadcast on the National Geographic Channel.

Scripps oceanographer Lisa Levin said the project's potential for generating public interest in deep-ocean science was as important as any new species that Cameron might have discovered.

"I consider Cameron to be doing for the trenches what (French undersea explorer) Jacques Cousteau did for the ocean many decades ago," she told the National Geographic Daily News website.

3 new habits: baby steps to better health - Carnival of Personal ...

Over the past two months, I?ve quietly been making changes to my lifestyle in pursuit of better health. Normally, I?m a State Your Goal Loud and Proud sort of taskmaster, and go for the gusto publicly, because that?s worked in the past. But because my health challenges are so unpredictable, and there?s a whole slate of things to change, I was actually worried that I?d do that thing where I?d ambitiously take on the world, start stumbling, and struggle to find my footing again.

It?s weird. Financial goals, no matter how outrageous, always seem achievable. Even if they are vastly out of reach, they aren?t ever daunting. But health goals are no longer that easy for me. They actually even make me a little insecure.

Knowing that, I?ve eased into the pool, a few toes a time. Picking a few areas where slack habits that were ingrained for a (bad) reason, I gave myself a new reason and new license to like the new habit.

1. New Habit: ?Missing the bus?.

In an effort to maintain work-life balance, I tried to stick to a schedule of leaving work at a certain time. This was partly because my public transit option was fairly rigid. If I missed a specific bus, every other bus behind that magic one was unreliable, late, or might not show up at all.

Triggered: Stress over the transit, grouchiness about getting home really late, double stress if PiC had to come pick me up because we?d both be extra late.

Conclusion: My work-life balance ?solution? was actually not always workable, it was exhausting when extenuating circumstances arose as they will in my position and the extra stress is unhealthy.

Solution: I found an alternate transit solution that required a mile walk. Now, if something really needs just a few extra minutes, or an hour, and it?s important, I don?t need to stress myself out over the choice between not getting it done or running for the bus. I get it done, and take a nice long decompression walk.

Now, I actually plan to ?miss? the bus more than once a week when the weather?s fine because it?s good for me. That removes all guilt-related stress from the equation. PiC knows that it?s semi-planned that it will be at least one to three times per week, I let him know as soon as bus-time nears, and he doesn?t feel pressured to rush around to accommodate an unexpected late day.? He knows that on those late days, he?ll just go to Plan B and everything goes more smoothly.

2. Spend Money. On purpose.

Mostly I?m frugal but there are days, and weeks, when I?m an absolute cheapskate because ?I just don?t feel like spending.? And being disinclined to shop just doesn?t help matters at all. Say, when it comes to necessities.

My feet take a pounding because I run around at work all day. Plus I?ve added the above walking regimen. You would think I?d be willing to get the necessary things to be well shod and comfortable. But it costs money and takes time to find such things, it requires dedicated shopping and I haven?t got the patience so I just won?t do it.

Triggered: Pain!

Conclusion: That?s just silly. I have smart, fashion forward friends who can make good recommendations and I can order online if I refuse to shop in-store. I?ve been walking around with blisters for nearly a month because my shoes have failed me. Now, where?s my sign?

Solution: I asked for shoe recommendations from friends who travel and walk like I do: in flats and a LOT.

I also remembered that Nordstrom has a really good return policy so I can actually try shoes for real, not just a few steps on carpet which isn?t at all a stress test of how they will feel when you have to commute in them. I ordered a STACK to try on and will keep the ones that hold up to real trial.

3. Chunking

Weekends are often saved for all those chores and errands that seem impossible to squeeze in during the week after a long day, at the end of a night: Laundry, grocery shopping, dry cleaning, car maintenance, cleaning of every sort.

Triggered: Exhaustion and a sad weekend when it?s all work and no play.

Conclusion: Trying to preserve the weekday and weekend divide between work and home just creates a lump sum of misery on either side of the wall.

Solution: I?ve been breaking off little chunks of errands like filling up the car with gas, or vacuuming just one part of one room, or clearing off a table top and fitting it into my day if I can squeeze in fifteen or thirty minutes. This still leaves the big stuff for the weekend but if there are only two or three big things for each day, that?s only a few hours? worth of work and a lot of free hours left!

These three items are my focus right now. I?m taking it slow and steady to let the habits become natural before I heap any more on my plate.

I did a bit of reading up on it, and found the case cited in online discussions about Shepard Fairey's 'Hope' image, which itself fell foul of an IP infringement claim. Plus ?a change and all that...

Image stealing is big business in the digital age. New technologies mean that old notions of copyright have become redundant ? or at the very least, unenforceable

Everyone does it but they don't like to talk about it. Should you meet someone who says they never do it then you know they're a liar. We aren't talking self abuse here, that's legal, we're talking copyright abuse ? stealing other people's creative work and passing it off as your own. You must have done it. Scanned a magazine image, copied one, downloaded one from a Net newsgroup or perhaps you slipped in that photo library image a second time? No one is going to notice after all- are they?

Chances are they won't unless it's a well known image. Copyright law is close to being unenforceable ? or as arbitrarily enforced-- as the laws on cannabis. The police do not hunt down those who trade in stolen images, no boys in blue stake out design houses and if you report a copyright infringement to the police nothing will happen. You have to defend your copyright personally ? and win or lose you're likely to come out poorer and angrier than when you went in.

The concept of copyright is as simple as its enforcement is impossible. It protects the expression of an author's original work ? where original is used in the sense of origin ? not new. This definition is important. Copyright doesn't protect an idea, just its execution. You have no copyright until you express an idea in some concrete form.

The form can be a painting, drawing, photograph, electronic file or smears of blood on car panels ? if it's an original work then you automatically own the copyright. The standards for originality are extremely low ? copyright applies to the drivel you sent your first love and the snaps you took of the resulting children on holiday.

It's all yours. No one can use ten per cent of your image, or five per cent. The law is clear on this. if it's recognisably your work ? in whatever form or however altered ? your copyright has been infringed. You can demand recompense and if you don't get it you can go to court, internationally. Copy right law effectively dates from the Berne Convention of 1886. The Universal Copyright Convention was written in Geneva in 1952 and heavily revised in 1971. Out of interest, you have fewer rights and countries have fewer duties to authors, under the UCC than under Berne. Not all countries, even now, recognise copyright or subscribe to the Berne conventions, though.

Oddly, when the US became signatories to the updated Berne Convention in 1989. UCC became less important. The full texts, requirements, duties and consequences of copyright law as embodied in the Berne Convention fill tomes, so we aren't going to print it all here.

National law modifies Berne, though it must add rights rather than subtract them. However, what the books on copyright law are bloated with is precedent. Copyright is messy and, with new technologies, harder than ever to define and defend.

For example, if you design and program an interactive 3D digital world for sale, is it subject to copyright as the expression of an idea or patent law as a machine? Who knows, it hasn't been decided. Software is subject to copyright but some software patents have been granted in the US. Computers have blurred the boundary between art and artifact.

OK, so you believe that your copyright has been infringed, now what? Well, if you do go to court you have first to demonstrate the originality of your work. This is where you should plan on losing a chunk of your life, your savings and future earnings along with your belief in justice. There is little new under the sun. Where are the Dadaists now, eh?

Most creative work grows out of other creative work. Ideas seek freedom, they fly from mind to mind where they change and mutate. Am I stealing your work or paying you the compliment of using your ideas? One is legal the other not.

Genetics of flu susceptibility: Why the flu is life-threatening for some, and quite mild for others

ScienceDaily (Mar. 25, 2012) ? A genetic finding could help explain why influenza becomes a life-threating disease to some people while it has only mild effects in others. New research led by the Wellcome Trust Sanger Institute has identified for the first time a human gene that influences how we respond to influenza infection.

People who carry a particular variant of a gene called IFITM3 are significantly more likely to be hospitalised when they fall ill with influenza than those who carry other variants, the team found. This gene plays a critical role in protecting the body against infection with influenza and a rare version of it appears to make people more susceptible to severe forms of the disease. The results are published in the journal Nature.

A central question about viruses is why some people suffer badly from an infection and others do not. IFITM3 is an important protein that protects cells against virus infection and is thought to play a critical role in the immune system's response against such viruses as H1N1 pandemic influenza, commonly known as 'swine flu'. When the protein is present in large quantities, the spread of the virus in lungs is hindered, but if the protein is defective or absent, the virus can spread more easily, causing severe disease.

"Although this protein is extremely important in limiting the spread of viruses in cells, little is known about how it works in lungs," explains Aaron Everitt, first author from the Wellcome Trust Sanger Institute. "Our research plays a fundamental part in explaining how both the gene and protein are linked to viral susceptibility."

The antiviral role of IFITM3 in humans was first suggested by studies using a genetic screen, which showed that the protein blocked the growth of influenza virus and dengue virus in cells. This led the team to ask whether IFITM3 protected mice from viral infections. They removed the IFITM3 gene in mice and found that once they contracted influenza, the symptoms became much more severe compared to mice with IFITM3. In effect, they found the loss of this single gene in mice can turn a mild case of influenza into a fatal infection.

The researchers then sequenced the IFITM3 genes of 53 patients hospitalised with influenza and found that some have a genetic mutant form of IFITM3, which is rare in normal people. This variant alters the IFITM3 gene and makes cells more susceptible to viral infection.

"Since IFITM3 appears to be a first line defender against infection, our efforts suggest that individuals and populations with less IFITM3 activity may be at increased risk during a pandemic and that IFITM3 could be vital for defending human populations against other viruses such as avian influenza virus and dengue virus" says Dr. Abraham Brass, co-senior author and Assistant Professor at the Ragon Institute of MGH, MIT and Harvard and the Gastrointestinal Unit of Massachusetts General Hospital.

This research was a collaboration between institutes in the United States and the United Kingdom. The samples for this study were obtained from the MOSAIC consortium in England and Scotland, co-ordinated from the Centre for Respiratory Infection (CRI) at Imperial College London, and the GenISIS consortium in Scotland at the Roslin Institute of University of Edinburgh. These were pivotal for the human genetics component of the work.

"Collectively, these data reveal that the action of a single antiviral protein, IFITM3, can profoundly alter the course of the flu and potentially other viruses in both human and mouse," explains Professor Paul Kellam, co-senior author from the Wellcome Trust Sanger Institute. "To fully understand how both the protein and gene control our susceptibility to viral infections, we need to study the mechanisms of the gene variant more closely.

"Our research is important for people who have this variant as we predict their immune defences could be weakened to some virus infections. Ultimately as we learn more about the genetics of susceptibility to viruses, then people can take informed precautions, such as vaccination to prevent infection."

Sir Mark Walport, director of the Wellcome Trust, said: "During the recent swine flu pandemic, many people found it remarkable that the same virus could provoke only mild symptoms in most people, while, more rarely, threatening the lives of others. This discovery points to a piece of the explanation: genetic variations affect the way in which different people respond to infection.

"This important research adds to a growing scientific understanding that genetic factors affect the course of disease in more than one way. Genetic variations in a virus can increase its virulence, but genetic variations in that virus's host -- us -- matter greatly as well."

Tevez could return for Man City as sub vs. Chelsea

MANCHESTER, England (AP) -Carlos Tevez could play for Manchester City for the first time in six months as a substitute in the English Premier League match against Chelsea on Wednesday.

The striker has not figured for City since refusing to take to the field as a substitute in September but has been training with the club for five weeks since returning from an unauthorized trip to his native Argentina.

City manager Roberto Mancini says "he is getting better but I don't think Carlo can have more than 25-30 minutes. ... Tomorrow we will decide."

City needs to beat Chelsea to trim defending champion Manchester United's four-point lead at the top of the Premier League.
